Terms and Conditions

These Terms and Conditions (“TAC”) may be altered at any time at the discretion of the Hellbored Pty Ltd ACN 111 157 852 as Trustee (“Hellbored”). Such changes will be presented at log-on however, each player should at all times be aware of their obligations pursuant to the TAC at all times. Failure to comply with the TAC may result in the immediate deletion of the player’s account. These TAC cover all accounts including players with "PLUS" status.

GAME LAW

Pursuant to game law, players agree to follow all game rules and laws. The game rules and laws may be accessed by clicking on “Rules” on the home page of this site. Failure to adhere to Game Law may result in the immediate deletion of the player’s account.

CONNECTIVITY

Hellbored does not guarantee connectivity.

AGE REQUIREMENTS

This game is not intended for persons under 13 years of age. Some content may be inappropriate for young children. By becoming a member of this site you are stating that you are thirteen years or older.

INTELLECTUAL RIGHTS

Any individual who attempts to reverse, engineer, hack, gain unauthorized entry into or undermine the system integrity of this site (including attempting to access any internal part of the game from an offsite location) will have their account(s) removed from game play and any future accounts closed. Such incidents will be legally followed through with the fullest extent of the law.

TERMINATING YOUR ACCOUNT

Individuals who no longer wish to play the game may terminate their accounts by not logging into their account. Players will be deleted at the end of each round.

USER GENERATED CONTENT

To the extent that portions of this site provide users an opportunity to post and/or exchange information and/or ideas, and opinions (“postings”) in chat rooms and message boards and via private mail, and in descriptions of alliances, please be advised that postings do not necessarily reflect the views of Hellbored. Although Hellbored may periodically monitor exchanged and posted information, in no event does Hellbored assume or have any responsibility or liability for any postings or any claims, damages or losses resulting from their use and/or appearance on or in conjunction with this site or elsewhere. Players are solely responsible for the content of their messages and postings, however, Hellbored reserves the right to edit, delete or refuse to post any postings that violate these TAC as well as revoke the privileges of any player who does not comply with the TAC.

OPERATIONAL INTERFERENCES

The players agree to not, through use of software or other means, interfere with site operation and page content. Any automated software written to interact with the game is strictly forbidden. Players agree to follow the administrated requests and instructions. Interference with this site and or failure to follow administrated requests and instructions will result in the immediate deletion of the player’s account.

PAYMENTS ETC.

The Player agrees that a purchase from Hellbored for such things as PLUS account status or tokens is a non-refundable charge. If a refund is requested your account will be terminated.

PRIZES

Hellbored reserves the right to deny delivery of any prize if they are not located in an eligible country. A list can be found on the "prizes" page.

FORCE MAJUERE

Hellbored shall not be responsible for any failure to perform its obligations under this Agreement, connectivity, loss of account information, if such failure is caused by events or conditions beyond Hellbored’s reasonable control.

JURISDICTION

Any dispute arising in connection with the validity, interpretation, implementation or performance of the TAC shall be at the exclusive jurisdiction of the Courts of Queensland, Australia. The TAC are exclusively governed by the laws of Queensland, Australia.

ADDENDUM

Other sections of the game may have its own rules such as the chat rooms. These rules are in addition to the TAC and do not replace the TAC. Violation of these rules are considered to be a violation of the TAC and will be dealt with accordingly. Players should familiarize themselves with all game rules before playing. Failure to be familiar with the game rules and or TAC is not an excuse for breaking them and will not be accepted as a defence of your account.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, HELLBORED DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTIABILITY OR FITNESS FOR A PARTICULAR SERVICE. HELLBORED DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS SITE OR MATERIALS WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVICE THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. HELLBORED DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULTS OF THE USE OF THE MATERIALS IN THIS SITE WITH THE REGARD TO CORRECTNESS, ACCURACY, RELIABLITY OR OTHERWISE. THE PLAYER ASSUMES THE COMPLETE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, HELLBORED, ITS AFFILIATS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES AND THIRD PARTY PROVIDERS TO THE SITE WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND INLCUDING WITHOUT LIMITATION, COPMENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR SIMILAR DAMAGES, THAT MAY RESULT IN THE USE OF OR THE INABILITY TO USE, THE MATERIALS CONTAINED ON THIS SITE, WHETHER THE MATERIAL IS PROVIDED OR OTHERWISE SUPPLIED BY HELLBORED OR ANY THIRD PARTY. NOTWITHSTANDING THE FOREGOING, IN NO EVENT SHALL HELLBORD HAVE ANY LIALBILITY TO ANY PLAYER OR THIRD PARTY FOR ANY CLAIMS, DAMAGES, LOSSES, AND OR CAUSES OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE) EXCEEDING THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE. USE OF THIS SITE CONSITUTES AGREEMENT WITH THE CURRENT TERMS AND CONDITIONS.

Rules

1. Multiple accounts

• One person may not ever use more than one account. Players may not log into another player’s account. Swapping accounts or trading account details will not be allowed.
• Any violation of the above will be treated as a case of multiple accounts and will result in the player’s accounts being locked or deleted permanently. Any subsequent accounts that a locked player signs up for will be deleted.

2. Illegal Transfers

• No two (or more) players who have shared an ip address at any time may exchange resources on the trade market, battle each other, or interact in any way. Even if you are not on the same computer later on, it is still illegal.
• Any violation of the above will be treated as a case of illegal transfers and will result in accounts being locked or deleted.

3. Communication

• Excessive cursing or flaming (insulting) will not be tolerated in any in-game communication (Message Boards, Mails, or Chat).
• Spamming of the Message Boards, or any player’s Mail is not allowed.
• You may not beg for game funds via Mail or on the Message Boards.

• Prejudice comments are not welcome on Universe Wars. Prejudice includes, but is not limited to: racism, sexism, ageism, and any other comments based upon the sex, race, religion, or creed of a group or individual. If you have opinions that could be regarded by Staff to be prejudice, please keep them to yourself while interacting with others in the game.

• No pornography. Universe Wars is for players age 13 and older and therefore may not have pornography. If there is any question in your mind about the acceptability of a comment, picture, or link, just don’t post it.
• Violation of the above will be punished by a Message Board Ban and in extreme cases will result in accounts being locked or deleted.

• Offensive or discriminatory Commander or Empire names are not to be used when creating your account. Any offensive Commander or Empire names will be edited by a member of staff. Any discriminatory or extremely offensive names will result in the account being locked or deleted.

4. Selling Property/Affiliate Links

• In-game assets may not be sold for real life money or funds in another game. This includes selling resources, tokens, plus accounts, accounts, or anything else that is transferable in Universe Wars. Additionally, you may not pay for items transferred in another game with Universe Wars funds.

• Players may not make posts that offer to pay other players for clicking a link to any other site, or going to another site and performing some action. Players may still advertise other games or websites on the Fun and Games forum, but only without offers of compensation. Referral links to other websites are not allowed to be posted in any Forum or Chat.
• Violations of these rules may be punished with message board bans or accounts being locked or deleted

6. Glitches/Bugs:

• Any player found exploiting a game glitch/bug will be punished with their account being locked.

7. Macros:

• A macro is a program that plays part or all of the game for you. Universe Wars is meant to reward players for their time spent on the game. Any one caught using a macro will have their account locked or deleted

• The Anti-Macro Protection Page is designed to prevent players from using a macro. If you fail to follow the directions on the Page, you will be locked by the System for two days.

8. Staff:

• Any problems you have should be mailed to the correct Staff:
• Plus account issues (anything involving a Plus account) should be sent to Andy. No other Staff member has the capacity to fix donation error and your mail will most likely be ignored and deleted.
• Message board/chat issues should be sent to Moderators or Jeff.
• Any information about cheating (i.e. multis, scams, etc.) should be sent to Jeff.
• Any problems with a member of Staff should be sent to Jeff.
• The Staff retain the right to make changes to this list without notice. Violating these rules will resulting in but not limited to a MB Ban, locking, or deleting of your account.
